All India Bank Officers' Association rules out possibility of agreement reaching conclusion.

Following is the version of All India Bank Officers' Association . It denies any settlement so far with IBA.


"The era of SMS / e mail is again at its overtime work.  As if the havoc is not enough the draft copy of the workmen agreement is being circulated under the name of IBA amongst members in Banks.
 
This is further confounded by the rumours that at 25th March agreement is being signed on Bipartite.  Anxious queries and spreading of information is taking place everywhere as to settlement is getting signed.
 
We have to clarify that the only meeting that took place for officers with IBA was one informal meeting with IBA Chairman on 15.02.2010 at Mumbai where after IBA office gave us a revised chart for scales and other items for discussions.
 
However the most contentious issue of pension balancing for SBI, incremental cost on pension and date of effect of pension etc., were not taken upon with IBA as it was decided that these issues would be decided in the UFBU meeting.
 
UFBU meeting is yet to be fixed and we are awaiting the same.
 
As far as officers are concerned our scale of pay, SBI pension balancing, pension date of effect and incremental cost remain to be decided yet.
 
Govt. is also yet to react on UFBU proposal of pension costing.
 
As such we call upon members not to be carried away by rumours.  No settlement has been signed and only after UFBU meets and disposes all pending issues and Officers’ Associations agree on the mainframe, agreement will be signed in day light for all to see.
 
Please bear with the delay caused on account of negative attitude of Govt., and Bankers on some issues."

"An appeal is made to all serving pension optee to unite & get prepared to file a writ against the pension load factor & present wage settlement. We (present employees who are pension optee) should not share pension load at any cost. Those retired in 1996 or onwards and now want to opt for pension must share the total burden. (They don’t even deserve to get 2nd option for pension because CPF was there conscious decision) We are not at fault they had taken decision to opt for CPF. They are increasing the load & as a result of which there is no compatible wage revision.
Our one step forward will save our future & dignity in the banking.
Let us unite and file a writ. Let us come forward."

AIBOA 's clarifications pin points on a negative aspect as a victory of Not signing a settlement after 29 months of Drama and More over rules out any possibility of any agreement before 31st March or in near future!! It seems that union stands for NOT SIGNING ANY AGREEMENT in coming months!
Further they have no shame to declare and chgallenge that any further talks will takes place only after the meet of UFBU, for which they have not decided any date!
As if Govt of India and IBA is objecting to hold a meet of Union Leaders itself. It is too much to digest.
Again and again the true color of Union Leaders are exposed and release of Draft Copy of workmen salary revision indicates to this fact.
In the history of Bipartite Settlement 9th BPS will stand alone in exhibiting the story of cheating Employees and Retirees for the benefit of few greedy union leaders.

Clarification shown the indifference attitude of Unions towards members.They have clearly exhibited that employees are their least priority.They are still in dark about the dates for meeting with IBA. Only when IBA offer a date everybody will rush to Mumbai hurriedly,without any preparation and come back without any result.

Dear Friends, Everybody is understandably anxious, frustrated, exhausted and what not? But the leaders are unitedly keeping mum. No high intensity comments nor any logic could open up their mind as well as mouth! And you know, now it is almost open and if the words of an All India Federation Leader of a responsible (or irresponsible?)Association is any indication, the MOU stands buried unceremonially. You know, the UFBU has become FBU - Fused Bank Unions or Fools of Bank Unions whatever may be - but in acgtual terms we the bankmen are the loosers. It is now learnt that the settlement may not resume for in the near future, for, the disintegrated UFBU leaders are not in mood to unite again. And in the meantime, IBA reportedly wants to corner at least Rs.300 crores out of funds allocated for Non SBI staff members (hiked from Rs.152crs)for funding SBI pension fund. This contentious issue may not get resolved. I am afraid, the wage revision itself has succumbed to inept handling of all concerned. Leaders are united only in not showing their fingers against the real culprit - that way everybody should be construed to be one!

I am very much perturbed to read the blogs of Mr Ramram and Ms Usharani - the people who are put in a pitiable predicament.

There are scores of people who demised....waiting desparately for the pension option and wage revision. In my office, one staff member died on his seat while discharging his duties as a result of brain haemourage thanks to his mental pressure owing to financial crisis - after putting in 30 years of service. Even one negotiating committee member from Corporation Bank demised during negotiations!

Sadly enough, we are living in a demacratic set up and still suffer in the hands of autocratic management and self centered leadership! Even God may not be able to help us!

Today I have seen one miracle and here I am going to put it.

"Re :Implementation of Defined Contributory Retirement Benefit Scheme(DCRBS) instead of the present Defined Benefit Pension Scheme for those Who are joining the service of the bank on or after 1st April 2010."

These are words of my bank's today issued circular for pension.

I can't understand How can It possible to issue this type of circular without signing of settlement or agreement with unions? In the circular clearly written that as per IBA order.

That means We should be clearly and at this time understand that Now from today no Existence of Unions.

Now seniors and blogger please clarify for me and all.

How can it possible?
What leaders are doing?

Its a direct attack on existence of Unions in Banking Sector.

Today again I am Alerting all my friends resign from Union don't talk and write,If anybody trying to convince you to not resign then bit them badly.

I am ready for reading all type of favoring of leaders and excuses.

b. Incorporating a clause in the appointment orders of the new
recruits/appointees from 01.04.2010 intimating them that they
would be governed by the New Pension Scheme.

2. These instructions have been issued to the Member Banks at a time when the bipartite discussions/negotiations on finalization of Second Option on Pension settlement are still going on and the MoU signed by the Unions on 27.11.2009 is yet to be turned into a reality .

2. In fitness of things, the New Pension Scheme can be introduced only after signing the settlement on the pending second option on pension. Only after signing a full pledged settlement , the Bank Boards can adopt the New Pension Scheme . In this background it is not prudent on part of the IBA to instruct the Banks Boards to adopt a decision to implement the New Pension Scheme. We are not in agreement with your decision. We suggest that the instructions to the Member Banks may please be withdrawn\held in abeyance.
4. As the New Pension Scheme is going to be implemented from 01.04.2010 and the new recruits/appointees would be covered by the above scheme as agreed in MoU, it would be sufficient if the Banks are advised to incorporate the clause in the appointment letters to be issued to those who will be appointed in the service of the Banks from 01.04.2010 to the effect that they would be governed by the new pension scheme being introduced in the Banking Industry wef 01.04.2010 and they would not be covered by PF and existing Pension Scheme.

5. We request you to send revised instructions to the Member Banks, keeping in view our above observations.

This can not happen without the consent of UNIONS or a direction from the Government of India. IBA which is so enthusiastic in implementing the New Pension Scheme with effect from 01.04.2010 WELL IN ADVANCE,is not showing the same eagerness and interest in extending another option of pension to PF optees with effect from 01/04/2008 as demanded by UNIONS.We do not know how many other rights have been surrendered by UNIONS before IBA before signing full settlement.

Airing of frustration over delay by a few in this blog ( hardly 10 are active ) is not going to spur the leaders into action. What is needed is mass action in the form of protest letters/resignation from the unions which alone would awaken the leaders from their cozy slumber. VAsudevan

what makes the union leaders to obey iba for these peanuts.Why they are tight lipped for these peanuts and when it will be signed .Are they threatned by IBA/Govt. Why they are coward having the support of huge memebership.In our bank the head of union leader was threatned by the management and now he is acting against the interest of the members.The age old promotion policy and transfer policy was thrown to dust bin and no leader is dare to ask the management.I think it is the same in all other banks also.So we are all in a pitiable condition, woking as slaves for nearly 12 hours.Some body has to come forward to set the things in a proper way.May the almighty help in this regard.

All top leaders have been 100% sold out and bought by the authorities that makes them tight lipped, shameless. It is certain that one can remain silent spectator to injustice in consideration of certain favours in kind or otherwise.

Leave alone the wage settlement, no union/associations are taking matters of 3rd class treatment with abusive languages to Officer category.The attitude of top level functionaries in ill-treating indicates systematic annihilation of Indian banking system with an aim to make way for Foreign/Pvt Bank flourishing.

think before the settlement has been finally signed and you feel cheated. I am closely watching the settlement talk of central govt employee and oil psu employee. what happens there. forgot the hike they got. It's true that they got a big hike but it's not come from union but it's employees crudely says then it's officer holding crucial postion give the authority not a single option other than a good wage hike which moves from upper to lower level and they got a big hike. If you observe the news flash at that time then find that all authority give a clear message in public that their core employee leave the organization if they do not got enough award, either it's airforce or army or navy chief or IOC or mumbai development corporation or any other govt body or organization each echo in one sound they need good packages to hold their good employee with them, but in banking sector we see that other than Mr o p Bhutt none of cmd come to public and give concern about their new recruits. what you think that you appoint ass and take work of horse from them and win a race, but it's happens in our industry. May be Govt signals their CMD (because cmd other than sbi have more interest to obey govt rather than well being of Bank) and IBA to go slow and give slow poison to the PSU banking industry so that after 10 Year they became sick industries because their quality of workforce are so degraded that their value that they earn is diminished and they are standing in front of govt with a bowl and govt easily sell them to their favorite comapny. If you think that I am not realistic then check out the fig that, after 2008 how much clerk and po bank recruit and how much clerk will continue with them. And a recent trend after 6the pay commission is emerge that other than SBI, a po recruitee will leave their job for a graduate level ie Assistant level job of central govt. What a signal you receive from such news, I receive that we are in ship in deep sea surrounded by big fishes which is going to sink and captain are in fighting to destroy the sheep and passenger are watching it and waiting for their became a meal of big fishes

During our days in 1992 persons were joining in bank PO leaving jobs like Income Tax Inspector etc. But as on day matter stands in competitive aspirants' arena that, an aspirant prefers even a job of a Tax Asst of Income Tax which in the scale of pay Rs 4000-6000 of fifth cpc and quits the job of a Nationalised bank PO in scale-I. In future unemployed will join in banks for employment but not talents as it was used to be happened in past years.

Collection by Unions :

(A) Contribution by Officers :

One estimates says that there are FOUR LACS OFFICERS and on an average they are paying subscriptions @ Rs.100. Thus, total monthly contribution by members / collection by unions is to the tune Rs. 4,00,00,000 (i.e. Rs. FOUR Crores). (This is based on simple calculation 4,00,000 x Rs.100).

Thus yearly contribution of Rs.48,00,00,000/- (i.e. Rs. Forty Eight crores)

(B) Contribution by Workman Staff :

Estimates indicate that there are about SIX LAC workmen staff and they are paying subscriptions @ Rs.40 (Average). Thus total monthly ccontribution by members / collection by unions is to the tune of Rs.2,40,00,000 (Rs.Two crores Forty Lacs). (Again it is a simple calculation 6,00,000 x Rs.40). Thus yearly contribution is Rs.28,40,00,000/- (Rs. Twenty Eight crore Forty Lacs).

(C) Total Contribution By Officers and Workman Staff Towards Union Subscription :

Thus, union leaders are enjoying contribution of Rs.76,40,00,000/- (Rs. Seventy Six Crores and Forty Lacs) per year.

How much members are spending on each meeting / each union leader i.e. How the collected Funds May Be Being spent:-



It is a known fact that there are only small amount of above contribution spent on Newsletters / Booklets etc. (Say Rs. 6,40,00,000 (Rs. Six crore Forty lacs) per year (i.e. Rs.64 per member). This amount of Rs 64 on newsleters for each member will be considered as on higher side by most of the members as these are received rarely and are mostly photostat / computer print outs, the copies of which are made only on bank's photostat machines / computers etc. by union leaders. Even if you receive five page circular every month, and cost per page is Re1, the total cost is Rs.60/- p.a.).

Thus, still Rs.70 crores per year is left with Union leaders. Let us assume further that each bank (say 50 banks) level union holds 4 meetings every year and spends Rs. 5 lacs (50 union leaders x Rs. 10,000/- ) on each meeting for stay entertainment etc. The total expenses will be Rs.10 crores per annum. Thus, balance left will be Rs.60 crores.

Let us further assume that each bank level union gives Rs.10 lacs p.a. to state level leaders to meet their local day to day travel for local union meetings etc. The total expenses under this head will be Rs. 5 crores (Rs.10 lacs x 50 banks). Thus balance left will be Rs.55 crores.

Let us further say that Rs 5 crores p.a. is spent at industry level for meeting contingencies and other expenses. The amount left is Rs.50 crores.

Finally, there are only 50 TOP union leaders (at the helm of affairs at each bank). Thus, they are left with Rs.50 crores i.e. Rs. 1 crore p.a. to be spent by each big leader, and in the manner and way they wish.

MOREOVER, THE ABOVE DOES NOT INCLUDE THE LEVY PAID BY MEMBERS EVERY FIVE YEARS (The levy amount can be staggering amount as it amounts to Rs.200 crores if members as mentioned above contribute @ Rs.2000/- each). Does anybody remembers, how much levy was paid last time and how much unions are expected to ask this time from each member? Members can do their own calculations. If Rs.200 crores are collected and put in a fixed deposit at the lowest rate of 6% p.a.,it earns Rs.12 crore as interest per year and the principal remains intact. What will be done by union leaders with this kind of money?

The collections done by unions from clients of the banks at the time of souvenirs or holding national conclaves etc. is not included in the above calculations. This can also be to the extent of few crores.

Is it the biggest scam of the banking industry?? Is this the reason that no union leader is neither ready to discuss nor disclose the amount spent under each head by the unions. We call upon all the members and union leaders to throw more light on this burning issue and the actual collections and the head-wise expenditure.

Are union leaders working for the members welfare or are they earning huge amounts at the expense of the members?

What is the use of crying here when everyone including our own representative or deaf and dumb.

Some of the blogger or their freind must be having Law background. Can we file criminal suit against IBA and UFBU for denying our constitution rights of equal pay for equal work. They alongwith the Baboos of MOF are having crimal conspiracy against all of us.

Can we not request the court to form a pay commission for wage revision of PSU Bank employees.

We are already paying huge money collectively these fools (so called leaders). We can easily divert monthly contribution being made these fools, to create a pool of funds for fighting our case in the court.

Can any one examine to initiate the process ?

Every progressive organisation wants to take care of staff by all means.Why is so that our CMDs of PSBs not interested in that. BOB and SBI had planned to give seperate pay structure once upon a time. In case it is not possible then who stops them to give the following on monthly basis

We can not demand Pay commission to bank employees.
It is appointed by Governments because salary of Government employees is paid out of budgetary allocation by respective Governments and NOT out of profit earned by staff.Whereas for bank employees salary is paid out of profit earned by each bank.After becoming member of IBA each bank authorizes IBA to negotiate with unions for wage fixation.
Before First bipartite settlement see the salary of bank employees awarded by Judges and binding on both Managements and Unions.
The award of the Sastry Tribunal to the clerks. It gave the following scales:-

On 1.9.1987 employees of Regional Rural Banks filed Writ Petition Nos. 7149-50 of 1982 and Writ Petition No. 132 of 1984 under Article 32 of the Constitution of India, 1950 challenging salary structure in these Banks. This court directed the issues to be referred to a National Industrial Tribunal. On 26.11.1987 the National Tribunal was constituted by the Government of India to consider the disputes relating to pay, salary and allowances payable to the employees of RRBs.

National Tribunal was already existing at that time and not appointed afresh as per courts direction.
Here also Courts may direct Government to refer anomaly if any to a tribunal. But Chances of Courts directing Government to APPOINT a Pay commission for bank employees wage structure is very remote. Affected employees may approach courts in case of anomaly.I am of the firm opinion, that formation of Pay Commission afresh for banks is only a dream unless all banks are merged.
Further,Governments always want to keep their employees happy in view of their role during election times. But they are not bothered about bank employees except extracting election duties from us. These are known facts.

No person has any moral or legal right to scold, blame or comment on any union/union leaders unless he/she is a member of that union. This is the minimum requirement as per law in any democratic set up. All blog writers are expected to know this fact very well. If not, all or any view expressed in the blog will be discarded as unauthorized and hence carry no value.
When I informed a union leader about strong views about inefficiency of unions, expressed by some blog members, he replied as above. Are we wasting our time and energy?

But if a person is adamant about not listening to others even in respect of true facts,better we think of other ways.I put forth my argument with my friend and leader of a union that they have to verify whether the views are true or false and not from which source it is emanating.

Why is there such inordinate delay in finalising the wage revision.This is resulting in injustice to all employees who are retiring now.
and whatabout the revision in the Gratuity act.Central Govt.employees have already reaped the benefits of the revision of 10 lacs.Why is no one pushing this issue.How is this delay going to affect the employees who are retiring now.
